Welcome to VOUFA.

These Terms & Conditions ("Terms") govern your access to and use of https://voufaworld.com/ and any associated website, mobile interface, services, features or facilities made available by VOUFA (collectively, the "Platform").

The Platform and the VOUFA brand are owned and operated by Fabelleoutfit Fashion Private Limited ("Company", "VOUFA", "we", "us" or "our").

By accessing the Platform, creating an account, placing an order, purchasing a product or otherwise using our services, you agree to be bound by these Terms together with our Privacy Policy, Shipping Policy, Return, Exchange, Refund & Cancellation Policy, Warranty Policy and Cookie Policy.

If you do not agree with these Terms, you should not use the Platform.

1. Eligibility

You must be legally competent to enter into a binding contract under applicable Indian law to purchase products independently through the Platform.

If you are under 18 years of age, you may use the Platform only under the supervision of a parent or lawful guardian who agrees to these Terms and is legally capable of entering into the transaction.

We reserve the right to refuse access, cancel an account or decline an order where permitted by applicable law, including where we reasonably suspect fraud, misuse, unlawful activity or violation of these Terms.

2. Account Information

Certain features of the Platform may allow or require you to create an account.

You are responsible for:

·    providing accurate, current and complete information;

·    maintaining the confidentiality of your login credentials;

·    promptly updating your account information when it changes; and

·    activities carried out through your account to the extent attributable to your actions or failure to safeguard your credentials.

You should notify us promptly if you reasonably believe that your account has been accessed without authorisation.

We will never ask you to disclose passwords, card PINs or OTPs through unsolicited calls, messages or emails.

3. Product Information

We aim to present product descriptions, photographs, dimensions, materials, colours, prices and other product information as accurately as reasonably possible.

However, the appearance of a product may vary slightly because of:

·    differences in screen displays, brightness or colour settings;

·    photography and lighting conditions;

·    production batches;

·    natural characteristics or variations in materials;

·    handcrafted or semi-handcrafted processes, where applicable; and

·    reasonable manufacturing tolerances.

Such minor variations will not by themselves constitute a defect where the product remains substantially consistent with its description and applicable quality standards.

Nothing in this section limits your rights where a product is defective, damaged, materially different from its description, counterfeit, spurious or otherwise supplied in breach of applicable law.

Product dimensions stated on the Platform are approximate unless expressly stated otherwise.

4. Availability

All products are subject to availability.

Placing a product in your cart does not reserve that product.

We may impose reasonable purchase limits or withdraw products where required for inventory, compliance, quality-control or operational reasons.

If we are unable to fulfil an accepted order, we will notify you and refund the amount paid for the affected product in accordance with applicable law and our Refund Policy.

5. Pricing and Taxes

Prices displayed on the Platform will be stated in Indian Rupees unless another currency is expressly shown.

Applicable taxes will be included or disclosed as required by applicable law.

Where a Maximum Retail Price ("MRP") is applicable, products will not be sold above the applicable MRP.

Shipping charges, COD charges or other permissible charges, if any, will be disclosed before you confirm your order.

Despite our efforts, an obvious pricing, typographical or technical error may occasionally occur. Where we reasonably identify such an error before fulfilment, we may contact you for instructions or cancel the affected order and provide a refund of any amount already paid.

Nothing in these Terms authorises us to engage in misleading pricing or unfair trade practices.

6. Orders

Your submission of an order constitutes an offer to purchase the selected products.

Receipt of an automated order confirmation does not necessarily mean that the order has been finally accepted for fulfilment.

An order may be declined or cancelled, subject to applicable law, because of reasons including:

·    product unavailability;

·    inability to verify payment;

·    suspected fraud or unauthorised transaction;

·    incorrect pricing or product information caused by an obvious error;

·    delivery restrictions;

·    force majeure;

·    legal or regulatory restrictions; or

·    inability to fulfil the order.

If an order that has already been paid for is cancelled by VOUFA, the applicable amount will be refunded.

7. Payments

Payment methods available at checkout may include prepaid electronic payment methods, cards, UPI, net banking, wallets, Cash on Delivery ("COD") or other methods offered from time to time.

Payment processing may be carried out by authorised third-party payment gateways, banks and payment service providers.

VOUFA does not ordinarily receive or store complete card numbers, CVVs, UPI PINs or banking passwords used to authenticate transactions.

You are responsible for ensuring that the payment method used for an order is lawfully available to you.

Additional COD or payment-processing charges, if any, will be disclosed prior to completion of the transaction.

8. Order Verification and Fraud Prevention

To protect customers and VOUFA against fraudulent or unauthorised transactions, we may undertake reasonable order verification.

This may include contacting you, requesting confirmation of order information or using automated fraud-prevention systems.

We will not request sensitive authentication credentials such as your card PIN, UPI PIN, CVV or OTP for order verification.

9. Shipping and Delivery

Orders are shipped in accordance with our Shipping Policy.

Delivery dates shown on the Platform are estimates unless expressly guaranteed.

Customers are responsible for providing a complete and accurate delivery address and contact information.

10. Returns, Exchanges, Refunds and Cancellation

Returns, exchanges, refunds and cancellations are governed by our Return, Exchange, Refund & Cancellation Policy.

Nothing in that policy or these Terms restricts rights or remedies that cannot lawfully be excluded under applicable consumer protection law.

11. Promotions and Discount Codes

Promotional offers, coupons, discount codes, gifts and sale campaigns may be subject to separate terms communicated with the relevant promotion.

Unless expressly stated otherwise:

·    promotional codes cannot be exchanged for cash;

·    only one code may be used per order;

·    promotions cannot be applied retrospectively;

·    offers may be restricted to specified products, customers, dates or order values; and

·    abuse, manipulation or fraudulent use of a promotion may result in cancellation of the promotional benefit.

Any restriction affecting a consumer's purchase decision will be disclosed appropriately.

12. Intellectual Property

Unless otherwise stated, all intellectual property associated with VOUFA and the Platform, including the VOUFA name, trademarks, logos, trade dress, product imagery, photographs, artwork, graphics, website designs, text, layouts, packaging designs, campaign materials, videos and other content, is owned by or lawfully licensed to Fabelleoutfit Fashion Private Limited.

Nothing on the Platform grants you ownership of such intellectual property.

You may access Platform content for personal and non-commercial purposes associated with shopping from VOUFA.

You may not, without appropriate authorisation:

·    reproduce or commercially exploit VOUFA content;

·    use VOUFA trademarks or branding in a misleading manner;

·    copy product photographs for commercial purposes;

·    falsely suggest association with or endorsement by VOUFA;

·    scrape the Platform at unreasonable scale;

·    circumvent security or access controls; or

·    create counterfeit or unauthorised VOUFA products.

13. Reviews and User Content

Where the Platform allows customers to submit reviews, photographs, comments or other content, you agree not to submit material that is unlawful, defamatory, fraudulent, misleading, obscene, infringing, malicious or unrelated to the product or service being reviewed.

We do not permit fake consumer reviews or reviews intended to materially misrepresent the quality or characteristics of products.

By submitting content, you grant VOUFA a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content for legitimate business purposes connected with the Platform, subject to applicable law and our Privacy Policy.

14. Prohibited Use

You must not use the Platform:

·    for unlawful or fraudulent activity;

·    to interfere with Platform security or functionality;

·    to distribute malware or malicious code;

·    to impersonate another person;

·    to attempt unauthorised access to systems or accounts;

·    to violate intellectual-property rights; or

·    in a manner designed to manipulate promotions, refunds, COD processes or other Platform functions.

15. Third-Party Services and Links

The Platform may integrate or link to third-party services, including payment processors, courier companies, social media platforms and technology providers.

Third-party services may be governed by their own terms and privacy practices.

VOUFA is not responsible for independent third-party websites merely because the Platform contains a link to them. This does not exclude any liability that VOUFA is required to bear under applicable law for services engaged by us to fulfil our obligations to you.

16. Product Care

Customers should follow any care instructions supplied with a product or displayed on its product page.

Damage arising exclusively from misuse, inappropriate storage, unauthorised alteration or failure to follow reasonable care instructions may not constitute a manufacturing defect.

17. Disclaimer of Implied Representations

Except for representations, warranties, guarantees or consumer rights that cannot lawfully be excluded or restricted, the Platform is provided on an "as available" basis.

We do not warrant that access to the Platform will always be uninterrupted or free from temporary technical issues.

Nothing in these Terms excludes any statutory warranty, product-liability obligation, consumer right or other liability that cannot lawfully be excluded.

18. Limitation of Liability

To the maximum extent permitted by law, VOUFA will not be liable for indirect or consequential losses that were not reasonably foreseeable and that do not arise from VOUFA's breach of a legal duty.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including applicable liability arising from defective products, fraud, wilful misconduct or violation of non-excludable consumer rights.

19. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses reasonably incurred by VOUFA resulting directly from your unlawful use of the Platform, fraud, deliberate misuse or infringement of VOUFA's or a third party's rights.

This provision does not impose liability upon a consumer merely for exercising a lawful consumer right or making a bona fide complaint, return or warranty claim.

20. Force Majeure

VOUFA will not be treated as being in breach for a delay or failure caused by events beyond its reasonable control, including natural disasters, floods, fires, epidemics, governmental restrictions, civil disturbances, strikes, transport disruptions, telecommunications failures or similar events.

Where such an event materially affects an order, we will take reasonable steps to communicate the impact and provide refunds or alternative remedies where required by applicable law.

21. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Subject to rights available to consumers under applicable consumer-protection legislation and other mandatory laws concerning jurisdiction, courts at [CITY, STATE] will have jurisdiction in relation to disputes arising from these Terms.

Nothing in this clause prevents a consumer from approaching a competent Consumer Commission, regulatory authority or other forum where the consumer is legally entitled to do so.

22. Changes to These Terms

We may update these Terms periodically to reflect legal, operational, technological or business changes.

The updated version will be published on the Platform with a revised "Last Updated" date.

Changes will not retrospectively deprive a customer of rights that had already accrued under an accepted order unless required by law.

23. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
